2024 Contract Law Question 2 — LawShortcut Independent Model Answer
Eddie films Susan's wedding as a favour between friends, privately assuming his usual €10,000 fee, and Susan's thank-you note grants him the rights to footage that later earns €20,000. The question turns on intention to create legal relations and on whether a note written in appreciation is supported by any consideration at all.
Scenario summary
Eddie is a professional videographer. He is a friend of Susan, whose wedding is approaching.
Susan tells him she cannot find anyone to film the day: the quoted prices are, she says, outrageous, but the real difficulty is that no videographer is free on her wedding date. Eddie offers to shoot the video himself, saying he would clear his diary for the day given their friendship.
On the morning of the wedding Susan hands Eddie a note. It thanks him for doing the video for free and, in appreciation, gives him full rights to use the video, or any part of it, to promote his business.
Eddie is taken aback: he had assumed throughout that he was to be paid his usual rate of €10,000. Rather than make an issue of it and ruin the day, he films the wedding anyway, intending to sort the matter out afterwards.
During the reception, Susan and the wedding party take a spectacular fall into the swimming pool. Eddie films it, posts it, and the clip goes viral, earning him around €20,000 in royalties.
Candidates are asked to advise Susan, as a matter of contract law, on two things: whether the €10,000 fee is payable, and whether her note handing Eddie the rights in the wedding video can be enforced.
